Consumer Directed Personal Assistance Program
(CDPAP)
CAPCO serves as the Fiscal Intermediary of this Program.
The Consumer Directed Personal Assistance Program (CDPAP) affords the Consumer (the individual being cared for) the opportunity to live in the community as independently as possible while taking on the responsibility of an active, consumer-directed role in the planning and implementation of their own homecare.
- The CDPAP is a long-term homecare program that enables the service recipients to receivePersonal Assistance Services free of the constraints that would otherwise be imposed upon them by a more formal health care environment.
- The CDPAP can enable a Consumer to hire & direct their Personal Assistant (PAs) in the provision of a wide range of services based on the Consumer's approved care plan that can include basic housekeeping, personal care or high level nursing services.

*CAPCO serves as the Fiscal Intermediary once a Consumer has been approved for CDPAP. CAPCO does not play a role in determining eligibility and enrollment into the Program, but we are happy to provide potential Consumers information on the process.
Eligibility for CDPAP
- Be a Cortland County resident!
For a person with a disability to participate in the Consumer Directed Personal Assistance Program (CDPAP), they must meet the following criteria:
- Must be eligible for and in receipt of New York State Medicaid and reside in Cortland County.
- Must medically require assistance in homecare functions, are in need of personal care services, or long term home health care program services, or AIDS home care program services, or home health aide services as determined by an assessment.

Must be self-directing, or have a legal guardian/approved self-directing other:
- Able and willing to make informed choices regarding the type and quality of homecare services to be provided and to participate in the selection, supervision, evaluation and termination of qualified service providers/PAs
- Able and willing to instruct service providers/PAs in required work tasks & set work schedules
- Able and willing to direct and oversee timekeeping of PAs within requirements
CDPAP Responsibilities
Consumer Responsibilities
- Consumers choose hiring selections for PAs that will provide homecare services;
- Managing the services of the persons (PAs) the Consumer employs, including recruiting/hiring, interviewing, training, supervising, and terminations as necessary;
- Resolve employee relations issues with PA(s), adhering to all regulations, including labor laws, Medicaid compliance, and best practices;
- Informing CAPCO of changes in Consumer status, or the PA(s) status, which may include hospitalizations, address changes, phone number changes; employment status changes of PAs; scheduled hours changes, etc.;
- Scheduling and arranging coverage within care plan & approved hours;
- Ensuring the accurate, timely, and compliant completion of PA(s) timekeeping, including electric visit verification (EVV) requirements;
- Completion of nursing assessments and other requirements per Medicaid and Managed Long-Term Care (MLTC) provider, including up-to-date authorizations;
- Monitoring of hours and days of care under the care plan to not exceed authorized hours;
- Accepting full responsibility for any personal injury or loss of property that may result from the action or
inaction of your PA(s); - Completion of all program requirements, both initial and ongoing, including adherence to CAPCO's Federal & State Healthcare Compliance Program, policies & procedure, and Medicaid Compliance training.
CAPCO's Responsibilities
- Processing payroll of PA(s) employed by Consumer;
- Acting as the employer-of-record for insurance, unemployment and worker's compensation benefits;
- Coordinating annual leave, health insurance, unemployment and other benefit programs for each PA on behalf of Consumer;
- Medicaid billing, including billing to Consumer's Managed Long-Term Care (MLTC) insurance provider for reimbursement of Personal Assistant services per care plan;
- Provide Consumers with information assistance, training, advocacy, and Fiscal Intermediary care management;
- Monitoring the completion of the required nursing assessment forms and the consumer agreement outlining obligations and responsibilities as well as other certifications and requirements;
- Monitoring the completion of annual employee medical forms and all required medical documents;
- Maintaining a personnel record for each PA including copies of annual health assessments and other related employment information, and the information needed for processing the payroll and administering benefits on behalf of the Consumer;
- Engaging in ongoing monitoring of activities that include periodic contacts with the consumer, and reviews of the nursing assessment, consumer roles & responsibilities, Medicaid compliance & other trainings, policies & procedures, other pertinent information minimally on an annual basis and more often as required by regulation or otherwise;
- Providing appropriate notification pertaining to any intention to transfer or terminate the Consumer from the program;
- Monitor the Consumer's continuing ability to fulfill those responsibilities documented in their record, including ongoing ability for self-direction;
- Develop & administer the State & Federal Healthcare Programs Corporate Compliance Program for Medicaid compliance, including Medicaid compliance training.
